Best Buy Finally Called and Asked Me To Return The GN

They asked you to take it back. Now you have an obligation to do so. I would do it. There is NO downside to returning it, but for the loss of use of it for a few days.

Um, no...no one is "obligated" to return anything once they've legally bought it, no matter now nicely the seller may ask. The purchase is a contract, entered into in good faith on both sides.

And as far as all this BS about Verizon saying "Return it or we'll fire the guy who sold it", that seems like blackmail to me. If they fire the guy, it should be about whether or not he followed company policies, not whether or not you give your phone back. If anyone told me that my job depended on what someone *else* did, I'd be talking with a lawyer. They're within their rights to fire him because he sold a phone early, not based on whether or not the buyer returns it.
 
He's called 3 times now. I'd answer and deal with it now but I'm at work and don't have the time to handle this. I'm guessing all hell is breaking loose over at that store right now. I'm a bit worried.

ok now i would definitely ask for $350 because of your time, aggravation, AND now HARASSMENT by this BB employee who has called you THREE+ times while you were at WORK. i'm sure that you don't appreciate getting harassed at work.

I'm going to pretend you didn't say that! As has been pointed out; you aren't under any obligation to return the phone. And I mean no disrespect with the next statement.... Are you @#$%&*? crazy?! They'd have to send the Army, Navy, Air Force, Marines and Coast Guard to wrestle that phone away if it was me that had it!
 
They might have FBI agents waiting at the door on your return...I still say SUE them for mental anguish.
 
I don't believe there is a moral obligation, at least because the company would acknowledge no moral obligation to its customers. Judging it from Aristotle's ethical standard of beautiful action, I don't see anything particularly noble about saving someone else's corporation from losing a relatively insignificant amount of money or suffering embarrassment. It would be magnanimous to do so, I suppose, but magnanimity loses force when the agents are so asymmetrical.

There would be an obligation if the person who sold it to him was a friend, and asked for the return. If an unrelated person facing disciplinary action, it would be nobler to return the phone; but not obligatory. An obligation is something owed; debts between the parties were discharged when the funds were exchanged. Asking for it back is an unreasonable request, and it seems hard to imagine being obliged to do something unreasonable.

Demand this. Demand that. Whatever happened to just being NICE to people? Understand, people make mistakes. Don't let whoever sold it to you get canned for this.

OP, just take it back and get a refund. If you don't have a spare phone, surely you have a friend who does, just to hold you over. Just because you might have them in a compromising position doesn't mean you have to take advantage of it.

It's your choice. I think if it were me I'd go with the suggestion of getting something for your trouble, like a phone to hold you over until it launches.
 
Wow, tough situation. Personally I would take it back, explain that you have no other phone, and ask for them to loan you a razr or rezound until it releases. Or just explain and see what they can do for you. In the end it's up to you how you handle it, we are all just giving you personal opinions, but hopefully things end up well for both you and them. I would hate for someone at BB to lose their job or get in trouble at the holidays just because of a phone.
 
You can still make emergency calls even with a black listed phone. I wouldn't put it past verizon to shut off the phone. Would want to send a message. Plus verizon could wiggle out of that lawsuit with one of many loop holes.

Agreed. It is actually in your contract that Verizon in not liable for any interruption of your service. I have heard this a lot from AT&T and a few times from Verizon on conference calls with customers while I was a rep for Asurion. Yes, they are usually nice and give you a slight refund, but if it is because you wouldn't return a unreleased phone that they feel is a problem on their network, they can and will blacklist the device. It is up to you if you want to follow that road but I would retuurn it, get a loaner RAZR and $100 gift card with the promise you havee first dibs when the GN is actually released. I think that is a WAY better deal than having a negative blotch on your Verizon Account. Carriers classify their accounts. Long term accounts with very few complaints/problems from the user tends to get you better leverage when things go wrong and you want that credit or early upgrade, ect.
 
i would tell them this - "Sir, first of all, I do not appreciate being called 3+ times in one hour by a BB employee especially when I'm at work trying to do my job. This is borderline harassment and it's not acceptable. BB's mistake and subsequent behavior is costing me a lot of time and aggravation. Returning the phone to you will cost me even more time and aggravation. I will return the phone to you for a full refund if you will compensate me, in addition to the full refund, for my time and aggravation in the amount of $350 in the form of a BB Gift Card. I think this is fair and reasonable. Otherwise, I will keep the phone and cut my losses."

Verizon can and most likely will brick your phone. Trust me.

Doubtful...at most Verizon is going to hit Best Buy for a contract breach per phone that was sold. An indirect here that sold one of the three they had is in a similar position. Manually entering SKU's to bypass the system does that not his problem. The store wants it back for one reason...Verizon is getting a chunk of change per phone and most likely threatening to put them on the back of the list for stocking purposes.

The bad press Verizon would get from bricking a phone that Best Buy sold early would kill any possibility of them doing it...imagine that headline across all the tech blogs...phone shut off at 6am, 7am hits blogs, 8am phone back up with credit on customers bill and an apology from Verizon for the misunderstanding.

This is the stupidest thing I ever heard! Seriously...he aquired the phone LEGALLY! There is nothing they can do! They won't blacklist him! He was sold the phone, so if anyone was going to be flagged in the BB system, it would be the douchebag that sold it to him!

You are correct, it is now legally his, but Verizon does not have to legally give him service to an unauthorized phone on their network. Until the phone is to their standard and released, the phone since they arre saying it has a software bug(s) can be considered unauthorized and a problem for Verizon's network. Plus what is wrong with being a good person and returning it with asking BB to give him the first one once it is officially released? Yes a lot of people really want this phone but why be a total ass when BB is really trying to get it back due to a mistake. Have you ever done something you regretted and asked for a second chance or to take it back? That is what BB is doing right now. They made a mistake, why not give them a break?
