They asked you to take it back. Now you have an obligation to do so. I would do it. There is NO downside to returning it, but for the loss of use of it for a few days.
He's called 3 times now. I'd answer and deal with it now but I'm at work and don't have the time to handle this. I'm guessing all hell is breaking loose over at that store right now. I'm a bit worried.

I don't believe there is a moral obligation, at least because the company would acknowledge no moral obligation to its customers. Judging it from Aristotle's ethical standard of beautiful action, I don't see anything particularly noble about saving someone else's corporation from losing a relatively insignificant amount of money or suffering embarrassment. It would be magnanimous to do so, I suppose, but magnanimity loses force when the agents are so asymmetrical.
There would be an obligation if the person who sold it to him was a friend, and asked for the return. If an unrelated person facing disciplinary action, it would be nobler to return the phone; but not obligatory. An obligation is something owed; debts between the parties were discharged when the funds were exchanged. Asking for it back is an unreasonable request, and it seems hard to imagine being obliged to do something unreasonable.
Demand this. Demand that. Whatever happened to just being NICE to people? Understand, people make mistakes. Don't let whoever sold it to you get canned for this.
OP, just take it back and get a refund. If you don't have a spare phone, surely you have a friend who does, just to hold you over. Just because you might have them in a compromising position doesn't mean you have to take advantage of it.

You can still make emergency calls even with a black listed phone. I wouldn't put it past verizon to shut off the phone. Would want to send a message. Plus verizon could wiggle out of that lawsuit with one of many loop holes.
Do a system dump so we can port ICS to the other LTE phones, then return it. Or don't return it, whatever floats your boat.
Verizon can and most likely will brick your phone. Trust me.
i would tell them this - "Sir, first of all, I do not appreciate being called 3+ times in one hour by a BB employee especially when I'm at work trying to do my job. This is borderline harassment and it's not acceptable. BB's mistake and subsequent behavior is costing me a lot of time and aggravation. Returning the phone to you will cost me even more time and aggravation. I will return the phone to you for a full refund if you will compensate me, in addition to the full refund, for my time and aggravation in the amount of $350 in the form of a BB Gift Card. I think this is fair and reasonable. Otherwise, I will keep the phone and cut my losses."
This is the stupidest thing I ever heard! Seriously...he aquired the phone LEGALLY! There is nothing they can do! They won't blacklist him! He was sold the phone, so if anyone was going to be flagged in the BB system, it would be the douchebag that sold it to him!
Keep the phone, unless you can get something awesome for it!
