OP: Good job, sticking by your guns. Sounds like they're pooping bricks, and hard to believe that even the store manager is such a dick about all this. And respectfully, unless you are a network engineer you are not qualified to express an informed opinion. AT&T's network has been brought to it's knees by iPhone launches more than once, to the degree that they put an inferior radio into it and then artificially inflated the number of "bars" of signal it had and forced Apple to make FaceTime WiFi only (works just fine on 3G on VZW).

I minored in RF Network Engineering and there is a big difference between what happened visa vi the iPHONE and at&t Mobility and what is (possibly) happening with the GNex and VZW.

With regards to the iPHONE, it was an issue of capacity both at the cell site itself and the greater network as a whole.

With regards to VZW (and this is strictly what I gathered from reading anecdotes RE: the VZW LTE Network), it seem to be an issue with stability (in general) and properly tuning the LTE radios (to work properly on the VZW network.

I wouldnt return it simply to piss off bestbuy and verizon. It might sound trollish.. but honestly they were suppose to have some responsibility in making sure it didnt get sold, and they let it get sold.. so let them deal with the consequences.

A lot of pages, so forgive me if this has been said before...
Tell them you'll gladly return the phone if, when it's released, they'll give it back to you (seeing as you already paid for it) and they free you from the 2 year contract, and let you go monthly as if your contract expired.
If I were offered that, it would probably sway me into giving the phone back.

As I posted yesterday. How did this help you. You returned they told you gtfo like I said they would. That's why you need to milk it for every penny since they have no heat u need to be just as crude in their pissing contest. you should have said you sold it or for 10 direct bank deposit they can have it and save some money vs the penalty and then say good day sir. If they disagree laugh and tell them to gtfo. I hope you learned your lesson that big companies will kill you when they can.

That phone is currently out in the wild in the US and active on VZW. As long as that handset is out in the world and in the hands of a customer, the entire country has a better chance of it being released. If the device gets returned, they can far more easily go about prolonging or canceling the launch.

Don't do a damn thing unless VZW's legal team contacts you. At that point, hand it over. Until then, you're helping every person in the US waiting on this device.

This phone is not coming out any time soon if BB is making this big a deal over a phone that's releasing in a few days just makes no since to me.You should keep the phone and sell it for big money when it gets canceled.

I just can't wait til they start calling again today offering me the 16gig iPhone again to return it. I'm going to tell them to call back when they have something to offer that's actually worth me returning the best phone I've ever had and then hang up.

EDIT: fyi I'm in sales and am good at negotiations. Just ask the guy who sold me my last car.

Just because one person has it does not mean anything for a launch. Hell people had the nexus one and look where that is....

I would not return it unless they are willing to give a lot of money. Everyone says have the moral decency and what not but if the tables were turn in some situation where YOU made a mistake don't think for even a second these two giant corporation would have a moral decency at all. That is what would make me not what to return it because those greedy son of a guns have screwed over innocent people thousands of times and not even cared. You think if you forgot to purchase insurance on a phone and dropped it either of these companies would help you if it was past the return policy but way before the contract expiration?
