No, it is not considered breaking the contract. It is considered making an offer to modify the contract and then having the other party to the contract agree to the modification.

Breaking the contract is when you refuse to pay what you owe or otherwise fail to perform your obligations under the contract.

Here is what happened with me - I made an offer to modify my contract when I called VZW and asked for the MHS feature to be added. 2 different agents of VZW refused the modification. The 3rd agent agreed to it. Doesn't matter that 2 refused it, only matters that one agreed to it. Contract sealed.

I'm glad I'm not an attorney :) i would hate my life lol. So what yo'ure saying is by them giving you unlimited data, your so called new contract with the unlimited data is sealed even though we didn't sign anything after the addition?

Only certain types of contracts must be in writing, such as contracts having to do with real estate. Verbal contracts are enforceable just like written contracts are.

Anyhow, you do have written proof that VZW agreed to the contract modification - your bill!
 
I bought a new Rezound today and the clerk and I got into a conversation about my plan. I was under the impression that when VZW did away w/their unlimited that those on the plan were allowed one more upgrade (within six mos?) and could keep their unlimited. After that they'd have to switch to one of the plans available at that time.

What she told me was that originally that was VZW's plan however, there was so much noise made over this that they changed it and anyone having unlimited prior to the newer tiered plans will be able to keep unlimited forever. And yes, I know I was talking to a rep so I guess this falls under the "believe it or not" category.

Although I'd planned on changing over to one of their plans that includes MHS without paying more money, I did keep my unlimited. If I want the MHS it's going to cost me :( so now I have to decide how bad do I really want the MHS? Ugh. Bad but not sure bad enough to pay an additional $20-$30mo for it.

I would never sign another contract and just buy the phone outright if that were true. I refuse to buy a Verizon branded tablet because $80 for 10GB is ridiculous and far too little. I'm not dealing with that on a phone.

did you add mhs back like the next day after you removed it? or did you wait for 2 cycles then add the mhs back?
 
Took the MHS off within minutes of getting unlimited data. Still have unlimited data 1 billing cycle later.
 
I just tried this last night and it still works, so for all those saying "it's not working anymore" you're wrong!
 
yea i tried three times

unlimited MHS only works for unlimited data lines...bastards

i could not get them to give me even 2 gb free....
 
I have unlimited data but have never tried to use MHS cuz I can't afford it. Are you saying if I turned it on on my phone I'd get it for free?

Those who were grandfathered into the unlimited will not lose it EVER...I was told this even when the tiered was just being talked about!

No that is not what anyone is saying. What they are saying is that if you do NOT already have unlimited data you can get it by adding the MHS FEATURE for $30 extra a month. That will switch you to unlimited data for $29.99 a month. Then if you don't want the extra $30/mo MHS feature, you disable it and you will be left with unlimited data.

If you want free MHS and you have a GNex, you can get it using the Switchwidget Pro toggle unrooted. If your phone is rooted, then you have other options.

That is their current policy. At any time they can change their policy to affect new contracts including renewals.

Even if they don't change their policy wrt unlimited data, they can start throttling the highest users like they do now on the 3G network calling it data optimization. I don't think they can do that until you renew your contract, though, without it being a material change and allowing you out of the contract.
 
OK this is all very interesting but I seem to be a little lost.

First off I seen all these replies to TheMiz which is my user ID everywhere expect here has been my nick name for as long as I can remember . So forgetting I am TheMiz51 here I thought I was losing it trying to remember these post.

I guess I am grandfathered with VZW my contract is up mid Feb. the wife now says she wants a phone she can use to text and get on the internet. Before she put that on me I was thinking of getting the Raz/r Maxx but now
I am not sure how to play it out. Is this all bad timing or should I put her on a family plan ext. Or would she also be grandfathered ?
