Yes i am aware of the patent law, but the line you are quoting in your post is out of context there. Yes Androids notifications do pop up and stay in the status bar unlike apples, but Apples IOS 5 software does pop up a notification when something new comes in (ie text messages, emails etc.) it does disappear, but you can still pull down and see all the notifications centralized in one place. That right there is what Google is filing the patent for. The pull down notifications, not the status bar notifications.

Patent infringement is decided based on the language of the claim. The way I interpret Googles patent is that when a user receives a new notification they are able to pull down a menu that has all their recent notifications in one central area on their mobile device.
