Ordered 1, got 2?

My friend ordered one 32GB Nexus 5 from the Play Store a couple weeks ago. His shipment came in last Wednesday. To his surprise, he actually had two packages from Google. Each containing a 32 Nexus 5. What should he do? Did he just get a free N5? He's only been charged once.

Your friend should just send it back.
Besides the fact that IF looked into it will probably show 2 phones were sent to that address.
 
Lots of good people. I would probably keep it for a few weeks, and if I was not charged I would just give it to a family member. If It had someone else's address on it, I would ship the phone to that person, but if they made a mistake and gave me two.....
 
I agree that doing the right thing is good. I really do. ...but to Google that phone is ~ the equivalent of .0000000000000000000000000000001 cent to you and I. ...which is the only reason I'd not lose too much sleep. Further, now that you've told us, you've also told them.

I'd phone Google or contact them telling them.

Maybe they'll let you keep it for free? At worst they'll pay for the shipping back. At worst, once they track down you have an extra one they may just charge your CC twice.

No company can legally charge you for a product you didn't order. In this case, it's their mistake, and the OP can be honest and return the product or be dishonest and knowingly keep something he shouldn't have gotten.

Not sure where you guys came up with the idea that a company can just send you a product then charge you for it. LOL. You think Amazon will just send you an $8000 tv with your toilet paper order and then just unilaterally charge your card? NOT LEGAL.

The OP has NO LEGAL OBLIGATION to return the extra phone. If Google makes a demand for return - then he may have a legal obligation to return it. Otherwise this is a MORAL issue.
 
That's a tough decision for you to make. I honestly don't know what i'd do if I were you in that situation. On one hand i'd like to think i'd be honest and not sell my integrity short for an extra phone. On the other hand, Google is so filthy rich that losing one Nexus 5 wouldn't be a huge hit for them. Especially considering THEY sent it to YOU and it's not like you walked out of a store with the intent to take something you didn't pay for.

I however, do not think I could ever really enjoy my phone because i'd thik about that every time I used it. I think i'd send it back and consider it an investment for good karma.

Do they have the ability to remotely lock both the phone and user?

I'm for the honest part, but you might want to examine both before returning one---just in case one has a problem. If you return a problem one, do let google know so they don't send it to someone else.

it has to be set up from users' side first, otherwise it becomes complete invasion of privacy.

Its not like OP is making google poor in anyway, I doubt they even care.

They could send you a notice that if you did not return it they would charge you. It can happen.

so i say keep it, its a gift from google! They do care more about putting device into users hand anyway. You are doing them a favor by turning another friend of yours into a walking cash machine for them!
 
This happened to me with a Nexus 4. I ordered a 16Gb model, got it, came home from work 2 weeks later, and another N4 was on my doorstep.
I called Google, and if I wasn't honest, they would've never known, because Google told me they had no idea a 2nd one was sent out.
I didn't get a reward, they just emailed me a prepaid UPS label, and I sent it back to them.
I know i didn't ask for it, and could've kept, it, but it is not me, and it wouldn't feel right to me.

That's good research. However, FTC Regulations are NOT binding authority in State or Federal Courts. Meaning, you need to continue your research into both statutory and common law in the State the OP lives in, and the Federal District.
 
Contact Google and send the phone back. Sure Google will never notice that 300 or so bucks but sending it back is the right thing to do.

When I was younger I always took angles and made questionable decisions and have paid dearly for them.

This is not necessarily the same and legally it may be your right to keep it, but I'd guess if they realize the mistake, they'd ask for the device back and if you've already sold it, they may charge you.
