That's good research. However, FTC Regulations are NOT binding authority in State or Federal Courts. Meaning, you need to continue your research into both statutory and common law in the State the OP lives in, and the Federal District.
here is what FTC says

Federal laws prohibit mailing unordered merchandise to consumers and then demanding payment.
If you receive merchandise that you didn’t order, you have a legal right to keep it as a free gift.
You have no legal obligation to notify the seller.

maybe state has more laws regarding it, but not sure if (and I doubt) it triumphs federal law.
if you've already sold it, they may charge you.
I don't think they can do that legally, nor do they care.
 
Yeah sorry I'd be keeping that phone if they contact me of course I'd return it but if they never notice their mistake that's on them. Perhaps they should be more careful next time!

On the other hand, Google is so filthy rich that losing one Nexus 5 wouldn't be a huge hit for them. Especially considering THEY sent it to YOU and it's not like you walked out of a store with the intent to take something you didn't pay for.

You're very good at dissecting a post. I didn't say it was okay to not send it back, I stated a fact that losing one N5 wouldn't be a huge hit for them. I followed that up saying that the right thing to do is still to send it back, and that's what I would do because I would feel guilty every time I used it.

It good to know you'd do the right thing and send the phone back.

Just wondering though. Perhaps whoever packaged the shipment included 2 on purpose and was authorized to do so but forgot to include the note of explanation. A gift from the irrevocably and filthy and overwhelmingly rich to the not so much.

Could always donate it to a good cause. Or sell it on eBay and donate the proceeds.

I'd keep it, sell it, or donate it. Google is one of the most invasive and richest companies on the planet, that phone costs less than $300 to manufacture and they likely had some little Chinese kid do it. Unless they ask for it, your friend doesn't need to give it back to them and probably needs it more than them.
 
I wish this happened to me I mean I would end up returning it but it would be nice to see if the flaws on mine are on another one..
 
This happened to me with another manufacturer many moons back. I called them and they had no record of shipping two, which meant no way to bring a device back into inventory. They just told me to keep it. I sold it to a buddy for cheap with the note that he had to sell it back to me if they ever asked for it back.

they won't, and you can take them to court and win if they do. lol
 
Google, like many other multi-national companies (Microsoft, Apple and Amazon included) are quite happy to use dodgy (but not illegal) accounting techniques to avoid taxes in countries they do business in and they don't care about the ethics of it. So why should you care about returning something they sent by mistake? If they don't ask for it back, I don't see a problem with keeping it, if you feel bad about keeping it you could sell it and give the money to charity. Although if it was a smaller, more ethical company that made the mistake I might feel a moral obligation to return it. But you do what you feel comfortable with.

I don't believe it for a minute. It's a good "what if.." type of question but I seriously doubt there is any truth to it.

It happens. When the Note 2 came out I ordered one from AT&T. They sent me two by mistake. I called and they asked me to take it to the nearest store. They didn't give me jack for my honesty but I didn't expect anything.
