It seems that this has changed. It will have the latest and greatest Snapdragon that will have the necessary DRM for streaming Netflix.

So is it safe to assume that this will be the first device to support Netflix instant watch on Android?

yes it will be the first and probably the only for at least a few weeks unless you got the app from the system dump.
