2. He gets the new phone at the subsidized price on his account by adding an additional line. Removes the phone from that line, but continues to pay the monthly fee, and gives you that phone to swap for yours on your account. You can then give him the "wet" one since he technically has bought it from you. He can then add the "wet" one to his account. If he adds insurance to his line then I guess he could file a claim and get a new one, but that would really be considered insurance fraud. He could then sell the phone on ebay and use the money to pay the ETF and drop the additional line.

You can register any ESN on any account just as long as the phone is not marked as stolen or lost in their system. I've done something similar to this except in my company we would renew one line to get the subsidized price of the phone to give it to someone else who needed a new phone on another account that was not up for renewal. As long as you keep paying for the account, Verizon could care less what account that phone ends up being activated on.

So, if the person who pushed the original poster into the pool decides to stop making payments on the replacement phone or reports it lost/stolen the original poster is screwed. To me these are reasons enough to require that the phone be purchased outright by the jackazz who pushed the OP into the pool.

Bottom line is the jackazz needs to take (financial) RESPONSIBILITY for his stupid actions and make it right. Why should the OP cut the jackazz a break that could ultimately be used to turn around and screw him?

No, after the initial transaction the new GSIII would no longer be tied to the other guys account, just whatever device he has on the line at the time. This is how people get upgrades, reactivate their old phones and then sell the new ones.

If I understand you, the line is tied to the account not necessarily to a specific phone.
So if the original purchaser cancels the line they are on the hook for the ETF for the phone and that action does not deactivate the phone originally purchased when the line was activated.
 
Save any correspondence from him, line up your witnesses and file in small claims court. It's not a 'beyond a reasonable doubt' thing in small claims court, it's 'preponderance of evidence', a much lower bar of proof. You will win.

Sorry to leave you all hanging. It was a time of great mourning.

The jerkoff who dumped me in the pool has committed to sending me 1/2 the price of the phone via check. I know that its not 100% recovery of the damages, but I am too tired of dealing with this prick over email that I'm calling it a day. I have many friends and an ex who are all lawyers and would be more than willing to help me out. I know that small claims court would be the venue to recover full damages however I'm over it. I put up the good fight however there are just Aholes out there in the world that you gotta deal with.

I received the new phone yesterday, a blue one (I had a white one). Now I am able to rock the blue phone with the white battery cover. It's pretty snazzy and makes me feel a little bit better. I also had titanium installed so all my apps / settings are there. Unfortunately I did not back up my entire rom / phone so all my homescreens / settings / etc are all out of order. I know that you guys can relate. It's a PITA.

Also, on an interesting note, my new phone came with a "Updated" sticker on the box and on the phone. (It's a brand new device). I assume this means the phone got the OTA update that everyone was talking about. Anyway, using the new "Updated" phone was a HUGE PAIN compared to the older version. The Android tips pop up all the time, in apps, on lock screens. It's insane. So I rooted, problem solved. Just an interesting observation.

Anyway, I'm just glad to have my SGSIII. I was contemplating switching to a old BB that a coworker has but I just can't leave this little SGSIII behind. Worth the $700, I think so.

3. you actually considered a BB?????? from a SGIII???? that'd be like going from a 2012 Ferrari to a 2001 Pontiac Aztek.
 
Well at least you got something from the dumbazz who pushed you in the pool.
Its completely your discreation on how far you took it .
At least you have your S3 back and happy,and getting or got it all set back up.
Hope ya have better luck with your new S3 and it last longer then did your other one even though it wasnt your fault the original didnt last long .

Wow, all I can say is your a bigger man then I. Anything short of a full replacement would have been unacceptable in my eyes and I would have taken it as a insult. The dude who pushed you in needs to man up and put on his big boy pants. Glad you at least have the sgs3 in your possession again!
