You can then give him the "wet" one since he technically has bought it from you. He can then add the "wet" one to his account. If he adds insurance to his line then I guess he could file a claim and get a new one, but that would really be considered insurance fraud. He could then sell the phone on ebay and use the money to pay the ETF and drop the additional line.

You can register any ESN on any account just as long as the phone is not marked as stolen or lost in their system. I've done something similar to this except in my company we would renew one line to get the subsidized price of the phone to give it to someone else who needed a new phone on another account that was not up for renewal. As long as you keep paying for the account, Verizon could care less what account that phone ends up being activated on.
So, if the person who pushed the original poster into the pool decides to stop making payments on the replacement phone or reports it lost/stolen the original poster is screwed. To me these are reasons enough to require that the phone be purchased outright by the jackazz who pushed the OP into the pool.
Bottom line is the jackazz needs to take (financial) RESPONSIBILITY for his stupid actions and make it right. Why should the OP cut the jackazz a break that could ultimately be used to turn around and screw him?
No, after the initial transaction the new GSIII would no longer be tied to the other guys account, just whatever device he has on the line at the time. This is how people get upgrades, reactivate their old phones and then sell the new ones.
If he doesn't buy you a brand new phone, shoot him. That is all.
