I'm on ATT with the grandfathered in Unlimted Data plan. I've had the phone about a month now. When I first got it, the Wi-Fi Hotspot app that came standard from Att would not work (since I do not pay for tethering.

Today for some reason I decided to open the app, and the app works and creates a Hot Spot.

My phone is unrooted and as standard as you can get. I have downloaded only a few apps, and none of them have been tethering apps.

Any idea why this would suddenly just turn on?

AT&T wants you to use it so they can take your unlimited plan away.

Does it say somewhere that if you use the wifi hotspot you will lose your unlimited plan? I've never heard that.

Per AT&T's TOS, you are required to have the tethering plan if you are going to use the hotspot feature. If they detect you are using it without the tethering plan, they could automatically switch you to the proper plan and you will not get the unlimited plan back.

That's a good question. Can they detect that you're using it? And if they wanted to take away grandfathered unlimited plans, why did they let people keep them in the first place?

I'm not sure about the detection. I'm thinking customers that upgraded to the new hspa+ devices where allowed to keep the unlimited plan because they started coming out at the same time Verizon got the iPhone and it was just a move to help retain customers. Really that question is unrelated. AT&T has never allowed tethering on the unlimited plan. The bottom line is, AT&T does not want tethering on the unlimited plan, nor allow it. If you do happen to get caught, you risk losing the plan for good.

So far, I have read they have only been able to target iPhone users. If you let usage get too excessive, they might take a hard look. Otherwise, I don't they will waste the resources to target non abusive users that are doing this.

I would think if they know when you've put your sim card into device that requires a certain type of plan, they will know if you are tethering when you aren't supposed to. I had to practically beg the stupid customer service person to reverse a plan change THAT I DID NOT AUTHORIZE after my minor child traded phones with his cousin and didn't know his data plan wasn't enough for that phone. Once I discovered it, I had him remove the card immediately. AT&T still showed his card in the other phone. Just saying they show little mercy...

They can tell what device you're using, but the only way they can tell if you're tethering is by the amount of data usage. They can't read the settings on the phone over the network. So I would think if you're not using an excessive amount of data, they won't know.
