Class Action Lawsuit

If any coorporation markets a product claiming it does ( or soon will do ) "X" and the product doesnt live up to that claim I think it's great if someone goes.after them for it. I don't care if it's a $5 metal wallet or a $500 cell phone.

Ironically, I don't care about skype or google chat but if those were promised and not delivered the consumer should be given some relief from the company...whether a new phone or something toward a new phone would be fair imo.

BTW, if your phone restarts daily there is something wrong with it. Mine hasnt done that since MR2 update.

The phone can use Skype and Google Chat.

All a class action suit does is make a group of lawyers richer $$$$ with the fees they get in a class action suit, while the consumers get some small trinket or credit ( like $10.00 off your next verizon purchase) for their troubleshooting. They are not worth the effort to offset the lost verizon will just raise prices.........:D

You're missing the point. The more often false advertising costs a coorporation money the less likely they are to do it.

There was a class action suit against Honda for poor brakes in the Honda Accord three or four years ago (the year the current style Accord came out) I was thrilled because Honda basically told me tough luck when I needed new brake pads after 13000 miles.

Guess what, the new Accords have much better brake pads. I'm on 37000 miles in my new Accord on original pads. I got a new Accord because the old one was totalled by a drunk driver and it was an insurance settlement.

As far as what the "false promises" were I'm not the op. I don't know what they are but if VZW made false promises the only way to curb that behavior is to sue them. If you read my comment IF company X Makes promise Y and don't deliver a class action suit is the consumer's only alternative.

Change to a different company? What good does that do? They won't miss one customer and one provider is as bad as another.

I have no idea if there is merit to a law suit against VZW but IF they made false promises then dismissing the idea of a class action suit because only the lawyers get rich misses the point. I don't care if they have to burn the money on their front lawn!

It was not working when I bought the phone at the Verizon store while I was standing next to a wall poster of the Thunderbolt with SKYPE written all over the poster. It still didn't work for almost a year and then NOT with the use of the front camera? Is this what one should expect from a billion dollar organization?
 
It does work. Also, you should have been aware that it was not available at launch. It is what it is.

Also, the phone was available in the spring of 2011 and the Skype front-camera video chat was available in the fall of 2011. Hardly constitutes a year. Filing a class action lawsuit because the eventual availability of front-facing video chat was not as soon as you wanted it to be is the very definition of frivolous.

I still don't think they were guilty of false advertising. Perhaps they jumped the gun a little bit. Regardless, nowhere near the example of life-threatening brake problems from your example.

They did months of advertising with Skype and then blog rumors about it not working days before the release. As I said, I was standing next to a Skype poster in the Verizon store at time of purchase. Maybe it's frivolous if it happens to a handful of people - but not thousands. This wasn't some 'frivolous' feature. This was a feature feature. That and 4G were the primary selling points. (4G is STILL not in my area 25 miles from NYC)

Yes, Skype did work in LATE fall. But NOT with the front camera (what's the point of that except to say you met your delivery???) . Easily amounts to more than 30% of a 2 year contract. THAT is the very definition of bullshi__ and not delivering what you promised.

So you're mad that you bought a phone that does every feature of a phone, and of a PDA, and almost every feature if a desktop computer, because it didn't allow for front-facing video chat, which is really useless in most social situations anyway? Or you are mad because you bought a 4G phone without living in a 4G area or having any firm date of when that coverage would arrive and then are mad that you can't use the 4G network?

Of course you can judge the value of a feature, for yourself... but you should stop there.
 
Your claims for a lawsuit is ridiculous, you would be at waste for making yourself look like a fool and losing the money to file the claim. I may be having issues with my Thunderbolt also (which Verizon hasn't done jack s*** about, but I am not going to make a lawsuit out of it). You know what I did? I contacted HTC directly and they are currently working with me, on how I cannot even reach the home-screen on my phone the way it is going they sound like they are either going to repair my phone free-of-charge, or send me a new phone. Wow imagine that being polite with a company is getting me somewhere :cool:.

Sorry if I come off a bit "angry" sounding, just trying to save you the embarrassment and the money. You know what you could get with that filing money?? Oh yeah, a new phone...
 
Besides if you where to bring a lawsuit.....the Thunderbolt will be nothing more than a footnote in the HTC catalog before the class action suit would see the light of day!
 
I read like maybe 4 posts..you all must be rockin stock. My rooted tbolt, one of the most heavily tweaked first 4g phones on the market...has had more Dev support than I can regurgitate..root the damn thing like it was made to be, find a cool updated and working rom and stick with it to find out just how great this phone still is. I rooted first day straight out the box, cause that's why I bought an android. If I wanted a phone with support from retailers....I'd have an Iphone still...just say in. HTC and vzw know how many people said f*&% sense and their crapdates and realized we got it better somewhere else. I'm rockin an ics rom...free tethering...all apps working flawless...no complaints on my tbolt. ;)
