Here is Where It Went Getting The New DNA as a Replacement Tomorrow

You just need to do a Google search to see that they were selling the phone with 100s of no sim complaints. The fact it was removed retired then re issued is another telling story.
 
So the final result is they can not send me a new model DNA so they are swapping out the DNA for a Note-2 it arrives on Friday.

What was the reasoning for not sending a new DNA? Im just curious because they usually wouldn't send you a phone that is more exspensive than your original device if for any reason the original is defective or they cannot replace with the original model. They would send you a device of the same price or less, in this instance, an s3 would be more likely. My husband original DNA was defective to the point that the LCD screen was illegible because there was little to no back light. we went to the store for a return and for five days they were sold out of dnas. On the fifth day he said screw it and requested a note 2. We had to pay the additional $100 in phone price and a $35 restocking fee for the defective DNA.

Well no once the phone is out of its 14 day return policy all they do is send you poorly rebuilt refurbished handsets.

If you are aware that after the initial fourteen days you get a refurb, why would you demand a new unit instead of a refurb? Not every DNA has expierenced the no SIM. Even if they did fix the SIM with this supposed new model, you have no entitlement to this new model. You owned the old model, it should, whether unfair or not, be replaced with the old model. A visa claim of this nature would not have a positive outcome in your favor. Not trying to be rude, but that's just my take on this. Yeah, it sucks that you bought a device that turned out to have a defect, but you should send it in for a refurb like every one else until you get one that doesn't. The rep that told you you were getting a new in box unit obviously didn't know what they were talking about. And I wouldn't be surprised if this note 2 ordeal falls through either.

I did they refused to replace the DNA with a new one. The Sammy Note two will be a refurb as well.
 
What I should have done looking back is drop the dam thing in the toilet and claimed it on my replacement policy. Assurian always replaces with new hardware. Next time I guess.

I thought assurion was who Verizon's insurance was contracted through, and I was told they only do refurb units..

Actually there should be a recall on the unit. A refurb would be acceptable for something that is a normal wear and tear problem. The SIM card failure is a known manufacturer defect. HTC is not owning up to it because they know they would be required to replace all the defective units. I personally think if HTC was a standup company they would send coupons for a free upgrade to anyone who is capable of proving they have this problem. I would be willing to bet it is a series of consecutive serial numbers that have this anomaly. This type of response would go a long way with their very dissatisfied customers.

I have a unit that has the sim problem. I clean it at least once a week. I do not exchange it because Verizon wants to give me a refurb. Refurbs are junk phones that really should of been put in the garbage. I did refurb for a long time and your chances of getting a decent refurbed product are not very good. Sadly its all about the Benjamin's which means manufacturers will be shoving even more of their garbage down our throats until we stand up to them and demand decent products.

assurion has a mix of new and refurb units, one time you will get new the next refurb, its the luck of the draw. its the same as with the verizon warranty replacement services, if they are out of refurb they will send you a new one. its happened to me a few times with previous devices. and they will not instantly upgrade or offer you another device unless you have had multiple replacements or the devce you are trying to get replaced is no longer offered.
 
The last phone I got from assurian was brand new in a retail box but that was a few years ago.

I don't think any company, no matter how "stand up" they are would recall items unless they affect consumer safety. And I don't want to hear anyone say "not having a working cell phone affects my safety, blah blah" because there are millions of people in this world who live just fine without cell phones. Also, I have the sim card issue intermittently and I'm not a very dissatisfied customer...

Those millions live without cell phones because either they old, don't have it all upstairs,or mooching of other people cells like I c a lot of people without one do. Yeah I lived without one but I was a kid. Plus here in America they giving away cell phones so theres no excuse.

Why come down on this guy because he spent his hard working money on something that does not perform as it is supposed to?
I don't care what it is, if I buy something that does not perform as suggested I will return it, period. Furthermore I would expect something in return whether it be my money or a like product.
Consumers like you hurt consumers like us; if it doesn't work, complain, take it back.....do something. Allowing large corporations to sell defective product is simply stupid.
This "homer mentality" on forums (all forums) is ridiculous.
I hope AndroidXTC gets everything he wants to make this right for him.

Only for insurance claims. Warranty issues are dealt directly through verizon.

Sorry, just seemed kind of harsh the way you characterized people without phones, I would guess there are quite a few people that just flat out can't afford it; the phones may be free but good carrier service certainly is not. Sorry for the response, guess it just hit me wrong.

Edit: Not sure where you were backing me up though, do you have me confused with someone else?
