Samsung Galaxy 3 saved pictures automatically

My daughters friend took an inappropriate picture of a young boy with my daughter's phone and my daughter didn't know she did it. My daughter had never seen the picture before because it wasn't in her main gallery...and through a weird chain of events she is now being charged with a sexting charge because a teacher found this picture on her phone. They proved that the other girl took it, but now they are still charging my 14 year old daughter with a felony for having the picture on her phone even when she had no idea it was there!! I need to prove that my daughter had no idea that this picture was on her phone or she will get charged with a felony!!! I need ANY AND ALL info you have that could help me prove that she is innocent!! Please!! This could ruin her life. THank you!

Welcome to the forums. The whole situation sounds pretty grim. I don't know how one can prove that your daughter had no knowledge of the photo, especially since it's her phone.
