After about 4 attempts spread out between a month and a half. I have the update. I work for at&t and the tech kept telling me, wait 24 hours, restart your phone etc. Come to find out, the only people who have actual access to the xdm (program they need to push the update) are techs that are called ASR Tech II. After talking to this tech, he was able to push it to my phone, I restarted it and there it is.

Since you work for the beast, I would love to hear some marginally technical information regarding how the Access Service Request uses the XPath Data Model to push this (UNE) through the ATT network. Are they just selecting nodes in an HTML document using a password or is it more complicated than that?

It might help to explain some of the extreme ATT madness that is evident in this thread.

Ensure the handset is one of the supported models listed above.
Ensure the handset has Android 2.2 or greater (Settings > About Phone).
If the handset is an HTC Aria, HTC Inspire, or Samsung Captivate:
Access XDM to push the most current settings to the handset.
Refer to Cross-Functional Device Manager (XDM) policy for your channel for procedures on using this troubleshooting tool.
The XDM setting to push: "(OEM) Allow Unknown Source True."
Example: "HTC Allow Unknown Source True."
For all other handsets, the setting cannot be pushed through XDM.
Customers must ensure their phones have the most recent software version. This is done by selecting Menu > Settings > About Phone > Check for Updates.
Check the Device Issues Logs for information on available software updates.

XDM=Cross-Functional Device Manager
You'd think a forum full of know-it-alls would have corrected me on that a long time ago. Explains alot.
XDM is not in the ATT Glossary of Terms and Acronyms, so I was just guessing.

Thanks
