Not again... Note 9 Fire Alleged in Lawsuit

What bothers me most is the reported claim by the plaintiff in this case is the allegation that Samsung should have known the devices are defective. That’s a bold statement to make. That would require some level of proof to support. At the very least I would think it requires some expert analysis of the faulty device and many more to samples to make a broad reaching claim such as this. I’m having a hard time believing that has happened. In any event, like many have already said here, there’s too little information to make an informed opinion about what has happened in this one case. For me, it’s nothing to worry over and I’m not the slight bit worried about my Note 9 and not gonna give it up any time soon.
 
This will either quickly go away or turn into a PR nightmare for Samsung, depending on how this plays out. The Note 7 was a big issue, to the point of them having to do a global recall, so another issue here and you could see the end of the Note series. Or, a Note series forever hampered by too small of a battery which I do not think Samsung would entertain. Let's not get too carried away, it's one case and to me it's a questionable case at this point so let's see how it plays out. The Note 7 issues make this one singular case spread like fire (no pun intended).
 
Every brand, and model of cell phones have a 50/50 chance of something bad happening to the batteries. It will or it won't. People are way too quick at making judgements these days.

Yes but when a company had previous fire related issues to the point of a global recall it obviously gets more attention the next time anything fire related pops up. Which is the case here. This will get attention and media spotlight - that's just the way it is. And it makes sense that it would. Sure there will be more to come out on it.

It's definitely not 50/50 chance of something bad happening. If that were the case, half the phones out there would be having battery problems and that's simply not the case.
 
They have done enough tests imo to know the batteries are safe imo and we wont see another recall like that again but as others said the press about the battery and the jokes about it that will start again will no doubt hurt the note sales and as previously stated if note 9 sales are not strong they might nix the line and no note 10. Maybe this will make it easier to find 512s in stock now lol.
 
makes me want to always keep my bottle water with me to keep hydrated , And incase my phone decides to explode to put it out .

Pouring water on a burning lithium battery isn't the right solution. It makes it even more difficult to extinguish.

I'm not sure how water would affect lithium battery, but they put it in a bucket of water to stop the fire according to article.

Edit: if water helps reignite the lithum battery maybe it had something to do with the water cooled carbon cooling in the phone .. we see when they start the investigation

Here's a copy of the complaint on which the NY Post article is based.

It was a Verizon model. There were two male witnesses to the fire once the elevator with the victim and her burning phone came to a stop. One of the males tried to pick up the burning phone with a cloth but that didn't help stop the fire. Eventually, the phone was dropped into a bucket of water. Pay attention to the description of the incident. The statements about the incident are made without the weasel preface of "upon information and belief." The complaint is signed by a lawyer (that's permitted because the victim lives in Long Island, whereas the attorney's office is in Queens; the place of litigation is in Queens because that's where the incident occurred). A lawyer, unlike a client, wouldn't risk his reputation in signing ("verifying" in legal terms) the complaint.
 
I read the news article and a couple things came to mind:

1. Where is the elevator video?
2. Where is the lobby video?
3. The article read funny to me, almost like a gossip magazine would in the sense of its elaborate, story telling verbiage.

Will be interested in seeing how this plays out.

1 & 2, probably being subpoenaed by the court as both the plaintiff and defense would want it.
3) That's the NYP for you.
 
The fact is even apple phone catch fire and possibly other phones as well. I'm not worried until there is an abundance of cases.

I was just coming here to post this same thing. There have pretty much been phones catching on fire from every manufacturer out there.

It doesn't stop with Apple with their phones. Apple had battery recalls on several of their laptops because they would suddenly explode or burst into flames.

:) At the end I ended up not going for the house. Too much had to be done to it, and they weren't budging so that was that. I first met her at an open out where she and a partner were showing the house. To be honest, she seemed quite straight forward and a good person so I'm not totally inclined on believing that she is trying to gouge Samsung or make a name for herself. But of course, that's from my point of view as a potential client. :)

The court is not going to subpoena anything; the court is merely an arbiter of disputes; it's the injured party's obligation to present her claims, and it's the defendant's obligation to present its defenses. At this stage, it's the obligation of the injured party to obtain any videos. Defendant Samsung wouldn't want to have any videos. Next, the injured party burned her fingers when touching the phone. If she sought medical help, her medical records become important.

I'm surprised laptops are allowed in your suitcase since the batteries do catch on fire. If that happens in the cargo bay the plane is on big trouble.

I don't think laptops or anything with lithium batteries are allowed in your check in luggage. I believe all of that is supposed to be in your carry-on.

I thought that was a temp ban last year on international flights worried terrorist would use laptops as a bomb hence were only allowed on carry on.

This is true. One of my local news channels uses iPhones and iPads for their scripts . On remote locations, they can be seen frequently looking at their iPhones to reference notes and other things.

They also report on all the major Apple events each year but never talk about the latest Samsung phones.
 
There are plenty of fan boys on both sides so let's just not go there :).
Yep and they just get a brief mention and other wise free pass but a couple Samsung's do it and everyone freaks. Too many apple fan boys.
