Thanks to Joey for the heads-up? this morning, a Delaware based Federal Court has ordered Apple & HTC to settlement talks on August 28, 2012. Hang tight everyone, this could be a bumpy news day.

Today the United States District for the District of Delaware ordered the lawyers as well unspecified decision makers of Apple and HTC to meet in Delaware on August 28, 2012, to discuss a possible settlement. The talks will be moderated by Magistrate Judge Sherry R. Fallon.
I don?t expect any major developments between now and the date set for this mediation effort that will put the necessary pressure on HTC to settle. HTC doesn?t have to fear any major legal breakthrough for Apple (not counting preliminary rulings) for at least the remainder of this year, and it now has bigger problems than this litigation.
If the Delaware court really wanted to make a contribution to a near-term settlement, it should un-stay all those lawsuits except for those claims that are still pending at the ITC. Even if the court did that, the matter wouldn?t be ripe for settlement by the summer, but then a mediation effort might succeed in early 2013.

Well none of us know what exactly went on in court this morning, and no one is reporting on the elephant in the room ? but I do know that we have some sort of movement on the devices sitting in the warehouse ? so as soon as I can confirm something in stone, it?ll be here.

i cant see us having to wait 3 months for this phone to come out. that would be insane. im assuming that the issue this week is waived, the phones will ship, and the battle will wage on later...
I don't think that will hold the shipment of the phones up anymore, but it could very well mean a software update after release.
someone on the sprint forums claims to have gotten an email today saying their phone was shipping with an estimated delivery of saturday. whether or not it's true is yet to be determined...
I would love to think that is true but in the same turn I dont want to think that because it is such a let down if it is false. :s
lol exactly. however, people apparently got emails from best buy saying the new date is 5/23 and someone claimed to have gotten an email from amazon saying 5/22. i wish sprint would send out some sort of email to those who ordered directly from them...
I wish i could just get an email that says, "hey we know you are still waiting, looking like saturday, monday, tuesday, or wednesday, just wanted to give ya a heads up."

It would not surprise me if there are 10,000 boxes already packed and labeled, sitting at a UPS hub just waiting to be released. It's 5pm in KY right now, it wouldn't surprise me even a little to see them ship every single one of them in the next hour or two, for an arrival tomorrow or Saturday to most customers.
It also wouldn't surprise me to see the red tape drag it into next week.
But for those who are thinking June or July for a launch date - no way. We are hours away from it.
