Just a few things to keep in mind here...I think at this point we need to stop with the pestering of Sprint. This is a situation that is beyond their control. Second, we need to be prepared that this may be a long process. Lets face it customs is not going to be the ones to make the decision that the One X and the EVO LTE are violating the patent in question. Customs will seize and hold any shipments that MAY violate but someone else will make that decision. How long that takes is anyones guess, but it would be safe to say that no one that matters in this case (US Customs and Apple) gives a crap how long this process will take.

I think where our anger may be better placed though is on HTC. I'm just guessing here like the rest of you but think about it. The One X was released I think 2 weeks ago right? No issues the phone was let in the country, no embargo. Why would that be? Nothing has changed with that phone since the release right? The problem might be that Apple had not seen the handset here in the states yet to make the complaint. Apple likely needed it in the country, get one in an engineers hands and have them determine if HTC was still violating. Again this is all guess work at this point but I'm thinking what they found was enough to piss them off to force this embargo.

Here is another thought too. I don't pre order a buch so you guy may be able to answer this better than I could. I was surprised that when I pre-ordered this phone that they charged my credit card at that time. My memory has always been with other things that either its a partial payment to hold a product and you get the ful charge when the item ships again this is not my thing so I'm not sure. I did think it was strange Sprint did this. I think I have also read that others were not charged unitl a few days later or even a day or so ago even though they ordered last week. This is where I wish we had someone who understood the law. Technically I have purchased the phone already even though it is not in hand. How does tha work with stock that is already here in the states?

I wish Sprint would make a statement that actually tells us something

Shipments of the HTC One X were possibly received in the United States before this April 19th deadline?
 
Don't get me wrong - I like all of you am a little bummed at the news and possibility of a delayed launch. But, this isn;t the first time I have purchased something online, been charged and told my order was processed, and then told that the item is back-ordered or out of stock and would ship as soon as it was available. There have been instances where I wasnt willing to wait and cancelled my order to buy what i wanted somewhere else. Then there have been times where I was willing to wait and got what i ordered as soon as it was available.

Fact of the matter is, we are all in that same boat right now. We just have no option but to wait until the item is available. Its not like we were singled out and there is a group of people that will be getting this phone and we won't. Regardless if HTC and Sprint saw this coming or not - or what your opinion of Sprint as a company is - they would not have made a big deal about the May 18 launch date if they even anticipated that on the 15th there would be a Customs holdup and patent problem that would delay it. Whatever problems they did know about they probably felt would be resolved by 5/17 so at the very least they could ship and have delivered to people on the Launch date. I'm ok with waiting a little longer personally. I'll still get the phone delivered to me, I'll still root it and set it all up the way I want, and I'll still be awesome. Patience is a virtue young grasshopper - our phones will come...

But what if it they are found to be in violation and it's back to the drawing board for the One series and Evo...?

Anyway, I have been reading the threat and at first when the story broke on the verge they didn't have the HTC statement in there. So again i'm sorry to trouble people with a link to a source.


Dude Android Central is pretty legit...It's not the early 2000's anymore. While yes a lot of information is garbage on the net so is the traditional tv and print media. We're talking about one of use speculating that the shipment is held up but one of the editors. However, while we are all kind of in a panic, it does not mean that there are not phones already in the stores.

P.S. I talked to employee accounts (I have a Sero account). We aren't getting our phones and the rumors of gift cards or something would not be coming from Sprint, possibly Best Buy if they chose to do it.

Great question. What happened to those? Better question is where is Sprint..

Unfortunately, the tracking status still just has the message "label has been created".Estimated delivery date says today, but that's not happening as I'm sure we can all guess.

I don't get why they would sit on product already labeled for shipping. Send it out!, at least satisfy some people if they can. Better than having everyone's ire.
 
If the UPS tracking system never stated that the package has left and moved anywhere, then it's safe to say that it's not going anywhere.

They receive a tracking # as soon as a label is created, but Sprint can sit on that label for however long...And you'll have a tracking # for however long, but unless it shows the package moving, then that's all there is, just that label.

Let's all just cross our fingers and hope for sometime next week at the latest.

Just spoke with Sprint. Was informed that ALL EVO 4G LTE phones are held up with customs until further notice. Ship/store dates are also on hold. SPRINT SUCKS! There are also NO chance to cancel your preorder. No phones are shipping at this time they said

Sprint does not suck. It is just a string of unfortunate events. It is a little bit of everybody fault. In the end the customer suffers.
 
Sprint's failure here is the almost comical lack of information they're providing to their paying customers. They've got no control of the customs issue, but they can control the flow of communication regarding the issue. I work in logistics, most of the freight I move is extremely time sensitive, and a delay means a store is not opening as scheduled, causing a loss of profit for my customers.

Dealing with border crossings and customs can be difficult, and seemingly small issues can delay freight for days. When delays happen, it's my job to carefully manage my customers expectations, and provide them with timely communication in regards to updates with their freight. This is where Sprint is dropping the ball. While the initial issue isn't their fault, they could be doing much more to communicate with all of us who have ordered this phone to let us know what is going on, what is being done to fix it, and when they expect resolution.

Agreed. htc and sprint should have had things ready more than 3 days before launch. Customs should have given them some warning when they saw the shipment was coming in. htc and sprint should be officially announcing updates to customers (htc did a little bit). It's a crap situation that probably isn't being handled the best it could be, but it's not Sprint trying to screw over their customers. This phone is really their best bet for keeping revenue up for the near future. lack of planning all around screwed everything up.
