Tab shutting down spontaneously

My galaxy tab is shutting down when the battery tops 40% what is it? Anybody with the same problem? Hopefully I'll buy a new phone but wtf is this? Is it hardware or software? I've not installed customs still touchwiz'd gingerbread

Did you update the os of the device?

No, when I bought it last year it came with android 2.3.3. I guess it is the RAM usage, the past 2.days it didn't shut down. I'll request help this week! Thanks

What if I have updated the os ! Actually I started facing the problem after updating my os .... it started shutting down at exposures to daylight, after a few days it started shutting down at 40 % battery, now it shuts down even at 80% battery. What kinda problem is it and what's the solution ? pls advice.

Yes, it was a problem with the custom OS, I went to the service center, they were unable to find out the problem unless I spontaneously instructed them to upgrade the OS, they did but didn't take any guarantee of the solution to my problems. However its been 3 days as of now and my TAB didn't show up with the problem any more.
