Is software malfunction covered by the manufacture warrenty?

[AC Question]

Friend has a STREIGHT TALK phone from Wal-Mart,
The device has many "error Messages"
It has deleted itself from many of the prompts even in the settings.
it has deleted all of the photos.
Right now, the only thing it does is answers and makes calls.

Its apparent that it is a software issue.
Everything so far has been done, per the manual and internet instruction to solve this problem.
She bought the phone from Wal-Mart around 3 months ago.
The manufacture warranty is for 1 year,
I would like to know if a software issue is covered.
The phone has not been hurt or altered.

Did she try a factory reset? Cache partition wipe?

I had the original Motorola Droid, when it would not accept an OS update it was replaced by Verizon at Motorola's instruction, it was under warranty at the time.
