I would think they'd have to have phone in hand to tell if it's rooted. Don't think there would be a way to tell over the air. Unless someone sends back a rooted phone I don't think we have to worry.

After looking it looks like they are adding parts of Sprints T&C.
This is from Sprint's site. Sprint is probably just trying to have a uniform Terms and Conditions across all their Brands

Typical TOS change when adding a new service like 4G. Check all the carriers, Im sure there is a clause in the TOS similar to this. I also imagine its because HTC offers a boot unlocker for most of their newer devices.

As for telling if your phone is rooted. The way Verizon did it was based on assumption. They were able to tell how many active phones were receiving the OTA upgrades. If a phone never upgraded they assumed it was because the device was rooted. Another way is to have the my account app ask for root access and if it gains root access then when it pings home for minutes, data useage, or text count it lets them know. There is a million ways they can do it.

VM can suck it if they kick me off for rooting. If they kick me off, I am leaving them. I cannot function without root access. Its that simple. Until I get kicked off though... I'm rooting.

Do you really (this is for everyone) think that they'll kick people off their service if they see that they are rooted? I mean really, how is that hurting them (they still will get my 40$ a month -_-)?

I also wonder the approximate percentage of "rooted users" out there.

But overall, they can put that there and enforce it, but I highly doubt that it will be enforced.

In my opinion this is the best Virgin Mobile Android device, but not when it's on stock Froyo. As great as this phone is root access just brings out the best of it. I'm sure that because this device has so much support that is why everyone wants theirs rooted, have you tried showing off your Android and comparing it to your friend's Androids? Chances are if you have CM7 or CM9 you have the better device, unless of course theirs is a GNex :x

I cant say for sure, but I have been using a rooted device for some time and I havent gotten the impression that VM is going to penalize or punish people who do it.

Thats just my opinion based on my experiences thus far. But who knows, with the change to 4G Virgin may toughen their stance. Its hard to say, really. I hope they'll be cool about it tho.

Especially since their mode of thinking will most likely be like this:

"We gave you 4G, unlimited I may add, a really good phone for a decent price, WITH ICS!!! Why do you guys still want to root?!"

Um... because we just spent $300+ on a phone, I'll agree that the service belongs to you (VM), but for that price, I can do whatever the heck I want to my phone.

Maybe its the tethering aspect of it all.I mean they see that root users are able to tether for free just by checking the market which is hurting them by trying to charge for the service but regardless I'm still rooting my evo v the day I get it.but I could be way out in left field with that assumption.....

Bah got the OV Won't root the Evo till the 2nd wave goes in.. if they survive then I'll play but I'm old and wize like that ;) The evo is good I hope out of the box and I Just lost my appetite for the rooting on it and will let those far greater than myself carry on but imo this forum just became evidence!! They can have the rooted OV when they pry it from my cold dead hand.. Naaa not really.. They can nuke me anytime anywhere so the gig is up kids me thinks.. It's been real

My guess is it's just about the tethering thing. There is no way they can tell or the big boys would have done it already. Its probably just a "going through the motions type thing". Sprint probably just kicked it in. Its like saying I agree to a utorrent Tos thing that says "you wont use this to copyright infringe".
