Shipping notification....Who's first?

I am no apple fan boy and I love android. But let's be real. This phone will not outsell the iphone5. Apple fans are just too dedicated for that to happen.

I wish we would stop comparing every phone that's released to the iphone line. It has been said for every flagship phone to be released that it will be the iphone killer....well I'm still waiting to see that happen. Again, dont get me wrong. I am android all the way.

I haven't seen any (non-fanboyish) site refer to any recent Android phone as an iPhone killer.

Nothing is going to kill the iPhone.

Well I was all about Apple products until the Evo came out. I saw what that thing could do and I was blown away. Not saying it was an iPhone killer, but it was good enough to kill my Apple dedication. How many people switched to an Android after seeing all the Evo commercials? Talking to people that had them? What do you think this would do to their sales? Not saying that it would stop them dead in their tracks but probably enough to be noticed. Obviously enough for Apple to reach out to other carriers besides ATT. If Apple wasn't concerned, they wouldn't be getting ridiculous patents like this one. Apple is definitely scared. If Google had HTC's back then Apple would really be concerned. I find it funny though that my NexusS is running stock ICS and links are available in the mail, texts and everything else. Obviously it is Android that has this issue. Why don't Apple make a stink over anyone else's phone. Google needs to start backing up it phone mfg's.


because its open source. Its ty, but its the manufacturers job to ensure the code meets regulations. They chose to use the code. Now if they had licensed the firmware, then google would have liability.
 
Well we're definitely running out of time today but I'd say we've got up until 5pm eastern for news to come out.
 
Here is some news from china post: HTC confirms court order to meet Apple for settlement talks

TAIPEI -- Taiwanese smartphone maker HTC Corp. confirmed yesterday that it has been ordered by a United States court to meet Apple Inc. in August for a possible settlement of patent infringement litigation filed by the Taiwanese company in September 2011.

HTC, a provider of smartphones and tablet computers running on Google Inc.'s Android operating system, stressed that it is only a procedure, part of the mediation process in the case that involves infringement on data-detection technology in mobile devices.

Apple Insider, a website dedicated to Apple-related news, recently reported that Apple and HTC have been ordered by the United States District Court of Delaware to meet for possible settlement talks on Aug. 28.

The report also noted that although there has been no indication which representatives from each company will participate, in separate court-ordered moderated talks with Samsung Electronics Co. of South Korea scheduled for early next week, it has been announced that both Apple and Samsung's chief executives will be taking part in the discussion.

The Taoyuan-based company, however, rebutted the conjecture, saying that it is not considering sending high-ranking representatives to attend the meeting with Apple.

In addition, HTC said that the case has nothing to do with the delayed shipments of two of its flagship smartphones to the U.S. due to an import ban on its products filed by the U.S. International Trade Commission (USITC).

HTC products that are imported to the U.S. after April 19 will need to be checked by the U.S. Customs for any patent infringement, but the company is not sure how long it will take to complete the review, according to HTC.

In a USITC ruling in December last year, HTC was found to be in violation of an Apple Inc. patent involving data detection. The company was given until April 19 to come up with an alternative or face a ban on U.S. sales of its handsets with the function.

HTC said earlier that the patent in question relates to a minor part of the interface and that the company will remove it from all of their phones soon.

How? for inventing something on OS9 and asking for their property to be enforced? They didn't call the ITC and say, "hey, can you hold these phones, and do your customs stuff?" No not at all. They won a court battle fair and square (in the eyes of the law) and now that judgement is taking effect.

I completely understand apple fans are zealots, but not thinking rationally about this is doing the exact same thing.

Its clear how you choose to spend your money, and what platform you support, thats fine, thats good, but "blaming" a company for something that (other than asking for a patent to be enforced) hasn't done really isn't necessary.

Yeah i do blame apple with great understanding that it is business and android has cut into there market share so they are running scared....customs has to do there job .....ever heard of cause and effect...or a domino effect ..

I'm sorry but this is BS. Of course you can blame apple. You're telling me that US customs stops every shipment of android phones (hello, galaxy nexus) to check their functionality and make sure that the data tapping patent is not infringed upon? Apparently all US one x and evoltes have been shipping with the custom sense "app association" settings. Cmon now, it's obvious apple singled out htc and alerted customs in order to screw up the launch on sprint. Like some others have mentioned, why hasn't the one s on t-mo been held up at all? Simple, because t-mo doesn't carry the iphone.

This might be a little naive. Honestly, its not like I have any inside information, but everything points to this being pretty unprecedented. All indications are that HTC has given customs a month to review the phones and somehow they've now been delayed long enough (1 day and counting) to create a pretty big PR storm for HTC.

I don't think it is outside the realm of possibility that Apple didn't have some pull in enforcing it on these specific phones (where's the One S?) and to have the ITC take its sweet time doing it. But then again, I could just be really cynical

Is it that simple? Maybe Tmobile has enough phones stateside already before the april 19th ban? Maybe they are awaiting a shipment as well, but it is still enroute, or maybe it hasn't shipped yet? If these things come by container (I assume they do given the amount of phones) then keep in mind it takes ~34 days to get something from china by sea).

It is my understanding the issue is with HTC (which is excluding samsung, lg, etc) and I am willing to bet Apple has pending legislation with each of these manufacturers as well.

Also, what does Apple have to feel threatened by? and why would the ITC bend to apples will? They are the largest company in the world, they will be fine with a less than 1% market share being taken up by a phone.

Assumptions make an ass out of all of us. I am willing to bet if the new incredible had been in those containers, the exact same thing would have happened to verizon. For all we know, the same thing is happening to verizon and tmobile, but nothing has affected them yet, so we have not heard from them yet.

Tmobile is #4, less subscribers, less demand for ONE of their models.
