i was denied at first and then accepted later on by the upgrade restore email,
heres my denial letter, then my acceptance.

Thank you for your response. After reviewing your account records, we found that your account currently reflects our Sprint Premier Silver status. A further review of your account shows that your balance is consistently past-due. In addition to meeting other requirements, your account must remain in good standing. This means that your balance must be paid in full each month by the due date. Our records reflect that phone line (xxx) xxx-xxxx will be eligible for $75 off the cost of a new phone on July 1, 2011, and will be eligible for full discounts and rebates on May 1, 2012. Regrettably, we must deny your request for early upgrade at this time.
To systematically upgrade to our Sprint Premier Gold status, your service plan must have a base monthly charge of $169.99 for shared plans and your account must remain in good standing. Our Sprint Premier Gold status allows customers to upgrade their primary line of service every 12 months. All additional lines of service are eligible for upgrade every 22 months. i sent 2 emails, exactly the same to the sprint cares and the upgrade restore, my upgrade was due this month if i hadnt been switched to silver. heres the acceptance email.

Thanks for your patience as I processed your request. Your upgrade has been restored and will reflect on your account within 24 – 48 hours. Please remember, this only affects the current upgrade. Once you take advantage of this upgrade, you will be on a 22 month upgrade cycle unless you become Gold. I appreciate your loyalty. Please let me know if you have any questions.
P.S. Just a reminder, there is no upgrade fee if you upgrade at Sprint.com. Just sayin’. =]
