You know if I was in your boat I would be angry too. It's easy for people who already have their phones not care about what is happening to potential evo buyers, but it is a sad situation and I would be pissed too. But sprint is really shooting themselves in the foot. They are not looking at the bigger picture as of this moment.

But I would not be too worried. My evo had a dead pixel, and I ordered to get the phone replaced and they said it will be shipped out next week, so maybe there is hope for a release sometime next week?
 
Yeah...actually I am frustrated with the whole situation - but it's like this:

There's stock somewhere sitting in a warehouse that isn't being sold.
Pre-orders should have totally been pre-filled first...and I get that....should people with preorders have exclusive rights to a product...hell no.
If there was limited stock, that would be one thing - this is about HTC/Sprint (whoever) not releasing stock first....they didn't even bother to send it to the stores or Best Buy (for example) - they only sent out pre-orders.

There's more stock waiting at Brightstar, whatever other Sprint warehouses...that's not being distributed..and no one's saying why. Guess what, anyone with any sort of basic economics will tell you that if inventory is sitting on a shelf - it's loosing you money...Great strategy HTC!

Where'd you get that info? All I've seen is that customs released limited quantities, and HTC is fulfilling pre orders first.

OK I understand the frustration and yes it would have been beneficial for HTC / Sprint to have phones out before the holiday but lets calm down for a second. We don't know what else is going on and it is rumored that the launch will happen next week. Rushing right now and something else happening especially with the holiday coming up would not have been good especially with the customs fiasco. Remember only the tech savvy who are on these forums know about this issue. The general public doesn't really know about this phone as of yet.

Now the gentleman who chose not to pre-order, well your right pre-orders don't have exclusive rights but do have first rights. It was easier and the best thing to push to get pre-orders out right away and then get them out to everyone else. In all you can wait for the SG3 which you don't really want or you can go to another carrier and pay more to make a point to HTC/Sprint which neither willl actually care.

What good is a phone with a fake (BS) network 4g? LTE this summer? I don't thing so, I live in the Metro Area DC/Arlington/Maryland/North VA , I went to Sprint because "unlimited" data... what a joke!
3 g speed is like ancient dial up! 248 kbps, Wimax almost nonexistent , I did cancel in the next 2 days, back to VZW , 3g speed 3480kbps 4G 9480kbps! Sprint business practices are unethical and unacceptables . also be aware that you cant download large files from your Sprint phone ,(I usually do download from XDA, Rootzwiki any ROM, with VZW thunderbolt)

What is the purpose of you trolling in this thread. I work in DC and don't have the issues you speak about. My phone works great for what I need it to do. So Sprint doesn't work for you where you are, ok then move on. This thread is about the new EVO phone that is unlike any other version out, so go to Verizon pay more and be happy with their selection of phones none of which is this phone.

Because they're both incapable of delivering a product that people want in a timely manner.

1. HTC failed to get the product cleared with the ITC before shipping it - resulting in a Customs inspection

2. The inspection actually goes faster than expected, and HTC fails to get the phone to it's suppliers in 4 freaking days - which may not sound like a lot - but is MORE than ample time for distribution

3. HTC refuses to comment on the situation - and the people who actually want to buy their devices sit in an information vacuum

Wonder why your market share is in the toilet? It's not because produce a bad device, the thing is beautiful - but you suck at "getting it" to the people who want it.

According to Inside.Sprint.Now tweeted at 8am today

Late last night it was discovered that a few shipments had mismatches between the ESN(serial number) on the outside of the box, and the device inside. This was not due to Customs, but rather a labeling error from HTC. It?s not a large deal, and care or webchat can clear it up for you, it will only take a few extra minutes when activating.

There is an expedited process in place for lost/damaged/not received packages? so if you get the runaround if you are having this issue, keep escalating until someone offers it.

And we still have no official launch date. The delay of this has been for a couple of reasons, the primary one being the promise to make sure that all pre-orders are available before the launch date. And this has taken a day or two longer than expected. Will we hear word of an official launch today? I?m optimistic that we will.

I called the ITC - got the same spokeswoman I spoke with a week ago when this stupidity began - she indicated that the Sprints portion with regard to the investigation was concluded earlier in the week and that "product" had been released by Customs...

No offense, but I don't believe that individual knew what they were talking about. The ITC and customs do not release specific information like that. HTC didn't even know what handsets were given the okay because customs wouldn't tell them.

I could totally get behind this if the unforseeable hadn't happened. If they knew apple would come after them and enforce their patents and HTC and sprint actually did nothing I might be a little ticked. Here are some problems though.


1. HTC and Sprint might have known but since Apple let One X's and One S's slide on in I don't think they expected it to become as full blown as it did. As a result OF COURSE the launch was going to get messed up. So yeah it sucks but life is full of unexpected surprises. Hell I bet some people are happy about the delay because they get a free case out of it.

2. If you're going to be all fire and brimstone about not being able to obtain a phone you might think about PRE-ORDERING. Yes it is giving money for thin air, but behind that thin air is the promise that YOU by giving money already (or by not, I went to Best buy and put down $0.00 for my pre-order) are going to be one of the first and first priority when device is shipped. So All the people saying "omfg when will they have stock graaarrrr *stomp feet*", as stated in point #1, s*** happens, delays happen. The only real way to be earliest to the party is to line up right away. Learn from your mistakes and there is a chance for growth.

3. Go ahead and leave HTC for Sammy or Apple or whoever, I doubt HTC cares. People who understand the quality of an HTC device and who actually like them would not jump ship over a little snafoo, HTC wants to keep customers who like HTC for their PRODUCTS not how things are conducted outside of them. If you're done with HTC, cool. I don't think they'll be crying too hard.

Facts: US Customs release a product 4 days ago, a product which had a hard release date, pre-orders, etc

Fact: As of today - the only ones getting any types of phones are those with Pre-Orders...why? Because it's the only stock allocated to actually go out the door. Yeah, good job Sprint and HTC - make sure that people who have money to spend on phones who don't particularly want to give you money in advance for nothing CAN'T get a hold of your products....great business model

I believe the process was that the inspectors are inspecting some number of phones per pallet or something. The ITC ordered the inspection to insure HTC complied with the previous ruling. The would likely have been considered derelict if they had actually OK'd it from a small early sample rather than phones randomly pulled from retail product. I suspect they are still doing it now as more phones come in.

Now, how long till some independent developer somewhere without crazy patent laws makes and releases a patch to add back the patent infringing feature?
