I believe the process was that the inspectors are inspecting some number of phones per pallet or something. The ITC ordered the inspection to insure HTC complied with the previous ruling. The would likely have been considered derelict if they had actually OK'd it from a small early sample rather than phones randomly pulled from retail product. I suspect they are still doing it now as more phones come in.

Now, how long till some independent developer somewhere without crazy patent laws makes and releases a patch to add back the patent infringing feature?

I'm actually banking on it lol. how do you stop it once it been released for general consumption? Is apple going to tarnish their reputation and public image by going after the little guy who just wants to customize his phone as he chooses? Especially on a feature that seems so flippant as to not be deemed worth of a patent? I doubt it. I say it is just a matter of time before that becomes a reality. Foreign Evo meet US Evo, how bout you swap some info :-*

I called the ITC - got the same spokeswoman I spoke with a week ago when this stupidity began - she indicated that the Sprints portion with regard to the investigation was concluded earlier in the week and that "product" had been released by Customs...

i think JBThree is correct.

From all that i have dug up, the so called "release" was not a "full fledge release", it was the "lift of a ban" that was prohibiting any movement whatsoever. The ITC lady telling you its been released is not the same as saying, "the product is now sailing thru customs at warp speed"

But nonetheless i am 1000% in agreement with you the release of this item from start to finish was very poorly handled. From not even having a LTE network to run the dang thing on, to that hideous black cover, from the over hyping of the Pre-Order Page Countdown...etc etc etc... Now having said that, whentheheckamigoingtogettoputmyhandsonthisdevice??!!

OK.. I had to chime in here..

Call me whatever you want (though crazy might fit), I don't get why ANYONE would buy a 4G LTE phone from a carrier that has not enabled it, nor will they for months to come. And from what I read, Sprint's 3G network is one of the slowest, not to mention that when you go to a Sprint store and ask if the LTE network will be simultaneous voice/data, they reply with a resounding "NO".

And reading the threads about the 1X doesn't impress at all, while ATT's LTE network is functional and expanding. And no, I'm not pushing ATT at all. I just don't get why the buzz for the EVO 4G LTE is so strong when there's NO LTE!

I sure hope you folks that have one are having less issues than those with the One X. Lots of folks in that forum are returning them since the update released didn't fix a thing. My $.02.
